Introduction

These conditions of sale (hereinafter simply “General Conditions”) govern the sale of services marketed by FOOD PROPAGANDA (hereinafter simply called FPR).

All contracts for the purchase of services and reservations concluded, through the website www.foodpropaganda.it and according to the procedures indicated therein, between the FPR and you, will be governed by these General Conditions.

All prices published on the website www.foodpropaganda.it include VAT.

Acceptance of the Conditions of Sale

The contract stipulated between FPR and you, the customer, must be considered concluded with the acceptance, even partial, of the order by FPR, which reserves the right, at its sole discretion, to accept your order. Acceptance is considered tacit, unless explicitly communicated otherwise to you (in any manner).

By placing an order in the various ways provided, you declare that you have read all the information provided during the purchase procedure and that you fully accept the general and payment conditions listed below.

If you are a final consumer customer (i.e. a natural person who purchases the goods for purposes not related to his/her professional activity), once the online purchase procedure has been completed, you will print or save an electronic copy and, in any case, keep a copy of these general conditions of sale, in compliance with the provisions of articles 3 and 4 of Legislative Decree no. 185/1999 on distance selling.

Any right to compensation or indemnity is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order by us.

How to Purchase

You can only purchase the services present in the electronic catalogue of the website www.foodpropaganda.it at the time of placing the order, as described in the relevant information sheets.

It is understood that the images may not be perfectly representative of its characteristics, and may differ in shape, color and size and that there may be errors and/or incomplete information in the description of the services.

All information supporting the purchase is intended as simple informational and educational material.

Order

Correct receipt of the order is confirmed by FPR by means of an e-mail response, sent to the e-mail address you provided to us during the purchase process. This confirmation message will contain the Date and Number of the order, to be used in any further communication between you and FPR. The message will show you all the data entered and you undertake to verify its correctness and to promptly communicate any corrections, according to the methods described in this document. Furthermore, you can check the status of your order by accessing the web area dedicated to you under the heading “my account”.

Prices

We remind you again that all published prices are VAT included. If you need a price list that shows the net price and VAT, we ask you to request it in the contact section, also indicating in which professional field you work in order to send you the correct price list.

FPR reserves the right to change prices at any time, without notice.

In the event that an incorrect and/or clearly derisory price is published, for whatever reason (error in our systems, human error, etc.), the order will be cancelled, even in the event of initial validation.

Cancelling orders/reservations:

Cancellation by the customer:
The customer has the right to cancel the reservation and obtain a full refund of the amount paid if the cancellation occurs no later than 5 days before the scheduled event date. In case of cancellation made between 4 days and 72 hours before the day of the event (3 days), a penalty equal to 50% of the total amount will be charged. In case of cancellation within a period less than 72 hours (3 days) before the event or no-show, no refund will be provided, unless otherwise agreed in writing.
Cancellation by us:
In the event that we are unable to provide the service due to force majeure events, including, but not limited to, adverse weather conditions, natural disasters or other circumstances beyond our control, we will provide a full refund of the amount paid by the customer. In such case, the customer will be promptly informed of the cancellation and the related refund.

Any changes to the reservation, upon request of the customer, will be managed compatibly with the availability and logistical conditions, following written communication.

Registration

In order to make purchases on the FPR website, you can choose to purchase as a guest or (highly recommended) register by entering your personal data. If you want to register on the website, you must provide all the requested data and you are responsible for their truthfulness and correctness.

In the event of registration, at the time of entering your data you guarantee that:

be of legal age and legally capable;
possess the specific registration requirements requested at the time of registration;
comply with all applicable laws and contractual provisions to these Terms and Conditions;
be the legitimate owner of the data entered, to be considered true, correct and updated.

Registration coincides with opening an account.

Upon registration, the User will be asked to provide some personal data, e-mail and a password.

By accessing your personal area you can, among other things, view your order history, modify your cart and add products of interest to your wish list.

The email address you provide during registration will allow us to notify you of all messages relating to services, products and the site in general.

It is forbidden to use temporary emails for registration. In cases of abuse, the Seller reserves the right to not accept the registration, revoke it, as well as to provide for the reporting for intervention to the competent Authorities.

All data transmitted will be treated in full compliance with the legislation on the protection of Privacy. We will use your data only to complete orders and only in the event that your explicit consent is expressed in this regard, the data may also be processed for the purpose of providing you with information on its commercial initiatives, such as news, gift vouchers or promotional discounts.

Payment Methods

Bank transfer

In case of payment by bank transfer, reservations will be valid only upon actual crediting to Food Propaganda’s current account.

Bank Check

Payment by any form of bank check is not accepted

Sella Bank

Banca Sella is a provider that manages multiple payment circuits and on the website www.foodpropaganda.it it offers the following methods:

Card payments
MyBank – Instant Bank Transfer
Google Pay
MultiSafepay

In case of purchase through the payment method offered by Banca Sella, at the end of the order you will be directed to the Banca Sella website.

The amount relating to the order is charged through Banca Sella at the time the order is acquired.

In case of cancellation of the order, either by you or by us, the amount will be refunded through Banca Sella.

Cancellation of the order is possible until the order is not yet being prepared in the warehouse. The order status is clearly visible in the “my account” area and is no longer cancellable if the indication “Order in progress” appears.

If you request cancellation of the transaction, under no circumstances can FPR be held liable for any damages, direct or indirect, caused by a delay in the release of the amount committed by Multisafepay.

At no point during the purchase process is FPR able to know your financial information and no FPR computer archive contains or stores such data.

For each transaction made with the Multisafepay provider, you will receive a confirmation email from Multisafepay.

PayPal

In case of purchase through the PayPal payment method, at the end of the order you will be directed to the PayPal login page. The amount related to the order is charged to the PayPal account at the time of the order acquisition.

The amount relating to the order is charged through PayPal at the time of order acquisition.

In case of cancellation of the order, either by you or by us, the amount will be refunded via PayPal.

If you request cancellation of the transaction, under no circumstances can FPR be held liable for any damages, direct or indirect, caused by a delay in the release of the amount committed by PayPal.

At no point during the purchase process is FPR able to know your financial information and no FPR computer archive contains or stores such data.

For each transaction made with PayPal, you will receive a PayPal confirmation email.

Unpaid orders

Unpaid orders will be automatically cancelled after 7 days from the order date.

Refund methods and times

Refunds can be made through the PayPal payment circuit, one of the circuits managed by Banca Sella, and by bank transfer at the customer’s request. The times for returning the sums are usually 3/5 working days.

Transaction Security

All online transactions with Credit Card can be made exclusively through PayPal or Stripe, through a Secure Server that adopts the SSL (Secure Socket Layer) protection system. This protocol, certified by Verisign, allows communication in a way designed to avoid interception, modification or falsification of information. FPR does not become aware of the data of the Credit Cards used by its customers.

Force majeure

We assume no responsibility for disruptions attributable to force majeure that prevent, in whole or in part, the execution of the contract within the expected time. We are not liable to you for any damages, losses and costs incurred as a result of the failure or delay in execution of the contract, the Customer being only entitled to a refund of the price paid.

We are not liable for damages resulting from disconnections, interruptions of the Site, or the loss of data that may occur as a result and attributable to the same.

In case of force majeure, the execution of the Order may be suspended.

This suspension may last for a maximum period of three months, after which we will decide together whether to continue or cancel the Order.

Intellectual and industrial property

The Site (and its content and graphics), the trademark, the domain name, the related subdomains and all intellectual and industrial property rights relating to them, are the exclusive property of FPR, are reserved for it and are not and will not be transferred or licensed in any case to the Customer. Therefore, you may not reproduce, duplicate, copy and redistribute, retransmit even on other websites, transfer or otherwise make available to third parties for any reason whatsoever or in any case use for purposes other than the conservation and/or consultation of the Sites and/or the Contents of the Site, without the prior express and formal approval by us.

Failure to exercise a right

Failure by us to exercise a right does not constitute a waiver of action against you or against third parties for the violation of commitments undertaken. We therefore reserve the right to assert its rights in any case, within the terms granted.

Jurisdiction and Applicable Law

The sales contract between you and FPR is deemed to be concluded in Italy and governed by Italian law.

For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, the territorial jurisdiction is that of your court of residence or your elected domicile of the customer.

Privacy Policy

The personal data collected through this site will be processed in accordance with Legislative Decree 196/2003, Legislative Decree 101/2018 and Regulation 2016/679 on the protection of privacy, and therefore will be used exclusively for the purposes indicated, kept confidential and communicated only to the subjects responsible for the delivery of the products (Post Office or Couriers) for the collection of payments and invoicing and in no other case will they be transferred to third parties. The subject responsible for archiving and processing the data is FPR.

The data collected will be processed in paper form or on electronic media for all purposes necessary for the execution of orders and the sending of periodic information (Information Newsletter) if you have made an explicit request. In all these cases, the provision of data is optional, but consent to data processing is essential for the performance of these operations.

FPR adopts the appropriate security measures provided for by the code for the protection of personal data, aimed at guaranteeing maximum security and confidentiality of the personal data processed. Pursuant to art. 7 of the code for the protection of personal data, you have the right to obtain confirmation of the existence or otherwise of personal data concerning you, and their communication in an intelligible form; the indication of the origin of the personal data, the purposes and methods of processing, the logic applied in the event of processing carried out with the aid of electronic instruments, the identification details of the owner, the managers and the designated representative, the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them in their capacity as designated representative in the territory of the State, managers or agents. You have the right to obtain the updating, rectification or integration of data, the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including data whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed, certification that the operations referred to above have been brought to the attention, also with regard to their content, of those to whom the data were communicated or disseminated. You have the right to object, in whole or in part, for legitimate reasons, to the processing of personal data concerning you, even if pertinent to the purpose of collection, to the processing of personal data concerning you used for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication.
